In compliance with the provisions of Law No. 29733, Personal Data Protection Law, and its regulation approved by Supreme Decree No. 003-2013-JUS, Frutos y Especias S.A.C. wishes to inform its users of the following aspects related to their personal data:
  1. INTRODUCTION. At Frutos y Especias S.A.C. (hereinafter “Frutos y Especias”), we ensure the utmost confidentiality and protection of the personal data of users who access the website: https://frutosyespecias.com.pe/. This document contains the “Privacy Policy” that governs the processing of personal data of users who enter their data on our website.
  2. LEGISLATION. This policy is regulated by Peruvian legislation, specifically by: • Law No. 29733 – Personal Data Protection Law (hereinafter, the “PDPL”). • Regulation of Law No. 29733, approved by Supreme Decree No. 003-2013-JUS (hereinafter the “PDPL Regulation”). • Information Security Directive, approved by Directorial Resolution No. 019-2013-JUS/DGPDP (hereinafter the “Directive”).
  3. RECIPIENTS OF PERSONAL DATA: The recipient of users’ personal information collected through forms is Frutos y Especias. Additionally, there may be third-party recipients who perform functions on behalf and representation of Frutos y Especias (personal data processing on behalf), which have access to the necessary personal information to perform their functions but cannot use it for purposes other than those specified in this Policy.
  4. PERSONAL DATA REQUESTED. The personal data requested from our users are: • Names • Address • Phone number • Email address
Additionally, specific information may be requested in case further details are required for inquiries or consultations.
  1. RETENTION PERIOD OF YOUR PERSONAL DATA: The user’s personal data will be retained as established in the PDPL and PDPL Regulation, for the time necessary to fulfill the purposes identified in point number 7 of this Policy.
  2. INFORMATION WE COLLECT: Frutos y Especias, as the data controller, through the forms on our website, may collect the following data:

If Frutos y Especias needs to collect additional data, it will inform the user in a timely manner and, with prior consent, about the purpose and type of processing for that information. Additionally, this section of the Privacy Policy will be updated as needed to describe such additional data to be known by our customers.

PURPOSE OF PROCESSING THE OBTAINED PERSONAL DATA The purpose of processing the personal data that our users enter in the website’s form is to be able to communicate with them in case a response is required and/or to establish contact. The personal data provided by our users will be stored in Frutos y Especias’ personal data banks located at Av. Huarochirí 160, Santa Anita, Lima 43, Peru.
  2. COMMUNICATION THROUGH TRANSFER OF PERSONAL DATA AND PROCESSING ON BEHALF: If Frutos y Especias needs to transfer personal data of its users, it will request their consent in advance. In other words, Frutos y Especias respects the privacy of its users and will not transfer their information to any third party unless the user has expressly indicated so.

PERSONAL DATA SECURITY: In compliance with current regulations, Frutos y Especias has adopted the appropriate technical security measures for the category of personal data necessary to maintain the required level of security, with the aim of preventing alteration, loss, unauthorized treatment, or access that may affect the integrity, confidentiality, and availability of the information.
  5. EXERCISE OF ARCO RIGHTS: Individuals have the right to demand that their personal data be processed properly. Therefore, users who have provided their personal data can contact Frutos y Especias in order to exercise their rights of access, rectification, cancellation, and opposition (ARCO) as established in current Peruvian legislation.
Users can exercise their rights by submitting a written request to our main office located at Av. Huarochirí 160, Santa Anita, Lima 43, Peru, in accordance with the “Model Format for the Exercise of ARCO Rights,” during the established public hours, or by sending the duly completed format to the email address: ventas@frutosyespecias.com.pe.
  1. MINORS: Frutos y Especias will not process personal data related to minors.
  2. CONSENT FOR PERSONAL DATA PROCESSING: By accepting this Privacy Policy, our users agree to all the aspects outlined in this document and authorize Frutos y Especias to process their personal data for the purposes mentioned above.
The user, as the data subject, expressly authorizes Frutos y Especias to process their personal data identified in this Policy, carrying out activities such as collecting, recording, organizing, storing, preserving, processing, modifying, extracting, consulting, using, blocking, deleting, communicating by transfer, disseminating, or any other form of processing that facilitates partial or total access, correlation, or interconnection of personal data, in the terms expressed in this Policy.
  1. CONSEQUENCES OF PROVIDING OR NOT PROVIDING YOUR PERSONAL DATA: Providing the personal data identified in this Policy and obtaining explicit and unequivocal consent contained therein will lead to the processing of the personal data provided by the data subject for the specified purposes.
As the data subject, you can refuse to provide your personal data; however, as a consequence of this action, you will not be able to make inquiries through the questionnaire on the website.
  1. VALIDITY AND MODIFICATION OF THIS PRIVACY POLICY: The Frutos y Especias website’s Privacy Policy was updated in November 2022. Frutos y Especias reserves the right to modify its website’s Privacy Policy in the event of a change in current legislation, doctrine, jurisprudence, or its own business criteria. If any changes are made to this Policy, the new text will be published on this website. Therefore, we recommend that our users periodically access this Privacy Policy, which can be found on this same website.
